AB 510 Good Time Disciplinary Report

NDOC Administration Notice, Dated 3/1/19:

NV-CURE has been advising all NDOC prisoners who have received a disciplinary report for filing false or inaccurate claims for the extra good time mandated by NRS 209.4465 (2007) to send us a copy of the disciplinary report and appeal documents.

We have addressed the problems and concerns regarding these disciplinary reports with NDOC Director Dzurenda, Deputy Director of Programs Kim Thomas and other NDOC Administration officials. These NDOC leaders have agreed these problems and concerns need to be addressed and appropriate corrective action initiated. We have provided the information we received and corrective action is being taken.

The NDOC Administration has requested NV-CURE publish in this newsletter a Notice to All Prisoners who received a disciplinary report and a guilty finding for filing a false or inaccurate claim of entitlement to the extra good time mandated by NRS 209.4465 (2007) to send the documentation and information relevant to their disciplinary proceedings and a short letter explaining your inappropriate filing and a request
for dismissal of the disciplinary finding to:

Director Dzurenda and Deputy Director Thomas are both interested in ensuring you are treated fairly in this matter.

Especially important in this matter is the fact that many NV District Judges incorrectly denied many prisoner applications for this good in original proceedings, these Judges were reversed by the NV Supreme Court for incorrectly deciding these cases and no disciplinary proceedings were filed against those Judges. A prisoner simply cannot be held to a higher standard of knowledge of the law than a District Court Judge.
